Conservatorships for adults
Conservatorship services
A conservatorship is a court case. When family members cannot serve, disagree, or prefer a neutral professional, the court can appoint a licensed professional fiduciary. I accept appointments in San Luis Obispo County and Santa Barbara County.
Conservator of the estate
As conservator of the estate, I manage income, bills, property and investments, file the inventory and accountings the court requires, and get court approval where the law calls for it.
Conservator of the person
As conservator of the person, I oversee where the person lives, their care and their daily well-being, and I visit and report to the court.
Guardianships for minors
Guardianship services
When a child's parents cannot care for them or manage their property, the court can appoint a guardian. I can serve as guardian of the estate to protect a minor's money or inheritance.
Guardian of the person
A guardian of the person is responsible for a child's care and daily decisions. Courts usually look to family first. When that is not possible, a professional can be considered.
Working with the court
Court appointed fiduciary
Judges and court investigators need a fiduciary who files on time, keeps clean records and communicates clearly. In court cases, the court reviews and approves my fees.
When I serve as fiduciary on a matter, property is handled through the trust or court process, and any potential conflict of interest is disclosed in writing and handled under 16 CCR 4476.
Common questions
What's the difference between a trust and a conservatorship?
A trust is a private plan someone made ahead of time. A conservatorship is a court process used when there is no plan, or the plan isn't enough.
Is a conservatorship the same as a guardianship?
In California, a conservatorship is for an adult and a guardianship is for a minor. Both are court appointments.
Fees
Hourly fees range from $200 to $275. My full written fee schedule is provided free on request. Call 805.235.4499 or email kristie@kristiecarter.com.
Trustee fees are paid from the trust as the trust and California law allow (Probate Code 15681) and are shown in the trust accounting. In conservatorships, the court reviews and approves fees (Probate Code 2640 to 2645).
